Nevada Supreme Court rejects NFL's appeal for rehearing in Jon Gruden case

LAS VEGAS (KSNV) — The Nevada Supreme Court has rejected the NFL's request for a rehearing after previously ruling in favor of former Las Vegas Raiders coach Jon Gruden's lawsuit against the league.

All seven justices signed an order dated Thursday denying the request. No reason was given in the order.

In a 5-2 opinion, the court ruled in favor of Gruden in August, allowing his lawsuit against the NFL and Commissioner Roger Goodell to proceed in Clark County District Court.

Gruden alleges that in 2021, the NFL leaked racist, misogynistic and homophobic emails he sent to a Washington football team executive during his time as a broadcaster, with the goal of forcing his resignation from the Raiders.

The NFL has denied the allegations and sought to move Gruden's lawsuit to closed-door arbitration, arguing he was still bound by the league's arbitration clause, even as a former employee.

The high court's majority disagreed, calling the clause "unconscionable" in Gruden's case. They cited Goodell's ability to arbitrate disputes about his own conduct and the NFL's power to amend the clause at any time.

Gruden's lawsuit was paused to allow the appeals process to play out. A status check on the case is next scheduled for Nov. 24.
