Patrick Mahomes Sued Over Trademark Infringement: Sneaker Company Claims Chiefs QB’s Restaurant “1587 Prime” Copies Their Brand

According to court documents obtained by ESPN, the sneaker brand claims it has prior common-law trademark rights to “1587” dating back to its first shoe sales on April 13, 2023. The company did not file a formal trademark application until October 2025, and that application remains pending with the U.S. Patent and Trademark Office (USPTO).

Meanwhile, Mahomes and his business partners filed for the “1587 Prime” trademark in December 2023 — after the restaurant opened in Kansas City — combining Mahomes’ jersey number (15) and Kelce’s jersey number (87) to create the name.

Trademark attorney Josh Gerben (Gerben IP), who is not involved in the case, explained the core legal issue to ESPN:

“The legal question revolves around the unregistered rights that the sneaker company claimed before it filed its trademark applications last year.”

The suit argues that 1587 Sneakers established first use and priority through actual sales and marketing, giving it protectable rights even without a registered trademark. The complaint seeks to block the restaurant from using “1587” and potentially recover damages.

What Does The Lawsuit Allege?

According to ESPN:

The suit alleges that “scores of consumers” have contacted 1587 Sneakers believing the company is affiliated with 1587 Prime. The plaintiffs’ attorney, Ezra Salami, declined an ESPN request for evidence to support that claim, but he said it will be produced should the case reach trial.

“From the onset, we have communicated a sincere belief that there is room for mutual respect and understanding,” 1587 Sneakers co-founder Adam King said in a written statement. “That belief has not changed, and we continue to hope to resolve this matter amicably.”

The sneaker company is asking for the restaurant group to no longer use the name, saying it causes confusion. The company also wants the restaurant to stop selling goods with the name on it and seeks to be awarded unspecified damages.

A publicist for Kelce declined to comment, and a representative for Mahomes did not respond to a message from ESPN seeking comment.

Patrick Mahomes has not commented publicly on the lawsuit. The Chiefs quarterback, widely regarded as one of the greatest to ever play the position, has expanded his business portfolio significantly in recent years, including endorsements, investments, and ownership stakes in ventures like 1587 Prime steakhouse.

Neither the restaurant nor Noble 33 has issued a response as of February 20, 2026. The case is ongoing in federal court, with the outcome likely hinging on evidence of first use, consumer confusion, and the strength of any common-law rights.

For now, the lawsuit adds another layer of off-field headlines for Mahomes during the Chiefs’ offseason rebuild.
