CLEVELAND, Ohio (WOIO) - Cuyahoga County Court Judge Hollie Gallagher dismissed Dennis Kucinich’s motion he filed against a Browns move to Brook Park, seeking a preliminary injunction to stop the move.
In the filing, Kucinich claimed that the City of Cleveland has failed to fully enforce the lease between themselves and the Cleveland Browns.
Judge Gallagher said Kucinich does not have any legal grounds to file the suit on behalf of the taxpayers.
[Last October](https://www.cleveland19.com/2025/10/13/stream-browns-mayor-justin-bibb-hold-430-press-conference/), the City of Cleveland and the Browns entered into an agreement for the team to move. The Browns would pay the city $100M, and would help remove the old stadium. The City, in return, would end their lawsuits.

The Browns still have the hurdle of the unclaimed funds lawsuit.
