Smith had previously claimed that both Republicans and Democrats of heightened stature knew about Epstein’s crimes, which included allegations of sex trafficking underage girls. He later condemned Trump and other political leaders who knew about the crimes for “clearly doing nothing” to stop the crimes he committed.

Trump signed the Epstein Files Transparency Act, a bipartisan campaign, into law on Nov. 19, which opened a 30-day window for the release of the files, after the legislation passed in both chambers of Congress with veto-proof majorities in November. As one of the loudest crusaders for the release of Epstein’s files in the sports scene, Smith is quick to voice dissenting political views that downplay the government’s efforts.

In his most recent response, Smith calls out at the Biden administration for not releasing the files during their four-year tenure after Epstein’s arrest with the question,“What am I missing!?” Sharing Smith’s latest views on the files, an X userwrote:

What Smith might be missing, was that the Biden administration was focused on investigating the case while Ghislane Maxwell was still going through appeals until 2024. That meant the files remained classified under court order. However, Trump’s second tenure halted the investigations before signing the Epstein Files Transparency Act, in line with a significant part of his campaign promises.
