Mark Sanchez's trial has been postponed for the third time

The trial of former NFL quarterback Mark Sanchez, who faces multiple charges including felony battery, has been postponed for a third time.

The 39-year-old is accused of attacking 69-year-old Perry Tole in Indianapolis last October. During the violent altercation, Sanchez suffered multiple stab wounds to his upper right torso in what was described as a near-fatal incident.

The retired quarterback, who was dismissed from his role as an analyst with Fox Sports, may have been under the influence of cocaine, fentanyl, marijuana, and alcohol, according to a filing by Tole’s attorneys in a related federal lawsuit. The trial was originally scheduled to begin last year, but Judge James Osborn has now pushed proceedings back to May 28.

In November, the case was first delayed from December to March, before being rescheduled again in February for April. The opening day had been set for April 9, but according to WISH-TV, Judge Osborn has now approved a pretrial conference on May 20, with the trial due to begin eight days later.

The latest delay follows a request from the defense team—marking the third time Sanchez’s attorneys have sought a postponement, though the reason remains unclear. A police affidavit alleges that Sanchez, who was reportedly smelling of alcohol, confronted Tole after he backed his truck into a hotel loading dock in downtown Indianapolis on October 4.

According to a civil lawsuit, Tole claims Sanchez entered his truck without permission and physically blocked him. Tole said he responded by using pepper spray on Sanchez, a claim he also gave to police. Authorities state that when Sanchez continued to advance after being sprayed, Tole then pulled a knife in self-defense.

Tole's attorneys also alleged that Sanchez may have had illicit substances in his system on the night of the altercation, citing a “preliminary investigation.”

"Plaintiff has cause to believe that Defendant Mark Sanchez ("Sanchez"), may have had multiple substances, including illegal substances, in his system that contributed to his intoxication at the time of his altercation with Plaintiff, including but not limited to cocaine, marijuana, fentanyl, and alcohol," the filing read in part, according to FOX59.

"Plaintiff has cause to believe that one or more of these substances may have been consumed in one of Huse's establishments which cause or contirbuted to Sanchez's impairment and his subsequent negligent and/or knowing conduct."

However, Tole’s attorneys did not present any supporting evidence for the allegations, according to the outlet. They are now seeking discovery in order to assess Sanchez’s level of intoxication at the time of the incident, as well as whether there was any prior knowledge of possible substance use.
