**The Premier League have confirmed Everton were wrongly denied a third penalty.**
David Moyes’ side found themselves on the end of another spot kick injustice in their 3-3 draw with Manchester City for Bernardo Silva’s foul on Merlin Rohl.
The loanee midfielder was held back by Silva at a corner while the hosts lead 3-2 late into their encounter with the title chasers at Hill Dickinson Stadium on May 4.
Referee Michael Oliver did not see the infraction in real-time while Paul Howard on VAR duty ruled that the offence had taken place before the corner was taken.
However the top flight’s latest Key Match Incidents panel unanimously concluded that the Blues were dealt a raw hand with a 5-0 vote against the incorrect call.
The ruling stated that, “there is a clear, sustained holding offence which continues as the corner is taken and the ball comes into play”.
It comes just a week after the same body [agreed that Everton should have been awarded a penalty](https://www.clickliverpool.com/sport/everton-fc/65246-premier-league-confirm-everton-denied-second-penalty/) in their defeat to West Ham for Mateus Fernandes’ handball.
The midfielder had swatted away the ball with his hand under pressure from Thierno Barry at the London Stadium but subsequent appeals were dismissed.
Stuart Attwell waved away protests while VAR operator Michael Salisbury stated that the contact from Fernandes had been accidental during the incident.
Earlier in the campaign, Everton were also denied a penalty after Arsenal’s William Saliba hacked down Barry in the penalty area of December’s 1-0 loss.
