Everton turn to Rabinowitz KC for £40m Burnley appeal

Everton have reportedly turned again to Laurence Rabinowitz KC as they prepare to appeal the decision ordering them to pay almost £40m to Burnley.

Rabinowitz led Everton‘s successful appeal against their first Premier League points deduction in 2024 and will now work alongside James Segan KC for the hearing scheduled for January.

The Lawyer reported the appointment on Friday, describing Rabinowitz as the silk who previously “saved Everton”.

Everton appeal Burnley compensation ruling

The dispute stems from Everton’s breach of the Premier League’s Profitability and Sustainability Rules for the period ending with the 2021/22 season.

Burnley were relegated from the Premier League that year, finishing four points behind Everton, and subsequently argued that they suffered financially because Everton had gained a sporting advantage through their PSR breach.

An independent commission ruled in Burnley’s favour in June and awarded them £26m in compensation, plus £9.1m in interest accrued up to July 2025 and further interest since then.

Everton immediately confirmed their intention to appeal, saying they were “surprised and angered” by a decision they considered “fundamentally flawed in both law and fact”.

Rabinowitz’s return is notable because of his involvement in Everton’s previous PSR appeal.

The club were initially deducted 10 points in November 2023 for their breach of the rules, but Rabinowitz led the legal team that successfully had the sanction reduced to six points the following February.

He will now be involved in another significant case for Everton, with the January appeal challenging a compensation award that could cost the club almost £40m if it stands.
