One year in the Championship is a sporting sanction. Executives who have watched nine seasons of inflated income want something that lasts longer than a promotion push.

Lawsuits sit behind the hearing. A fine changes the mood. Expulsion changes the claim.

Executives at several Premier League clubs have told the Guardian that relegating Manchester City for a single season would be insufficient after an independent commission found them guilty of the vast majority of 115 financial charges. The scheme artificially inflated income by £900million between 2009 and 2018 through what the commission called a disguised funding operation and sham commercial deals.

“Relegation to the Championship for one season would be insufficient,” a club source said. “The commission has to arrive at a punishment that is proportionate for years of sustained and deliberate cheating, as well as providing a strong deterrent to it happening again.”

Clubs do not sit on the sanction panel. The Premier League, as prosecutor, can ask for a punishment. The board that sets that position is chair Alison Brittain, chief executive Richard Masters and three independent directors. The same commission will decide the sanction after City’s appeal, which must be filed by Friday. Under rules brought in this season the appeal should be heard within 12 weeks and judged within 30 days, pointing to a decision by the end of January. City may argue those deadlines should not apply to historic charges. They have already delayed publication of the core decision once.

City say they are “innocent of the accusations made by the Premier League and a comprehensive body of irrefutable evidence exists in support of all of its positions, relating to this case.” Available sanctions include points deductions, a transfer embargo and expulsion. There is no precedent on this scale. Everton were docked 10 points for a £19.5million overspend, reduced to six on appeal, after the league asked for 12.

Arsenal, Manchester United, Tottenham and Liverpool reserved the right to sue two years ago and have held informal talks about a claim now the judgment is out. Burnley were awarded £35million from Everton after arguing a PSR breach caused their relegation. The size of City’s sanction will shape whether those claims are pursued.

The Guardian also notes lingering anger at Chelsea’s agreed £10million fine for self-reported Abramovich-era payments. For Arsenal the sporting file and the legal file are now separate. Last season’s title is already won. A one-year drop, a longer absence, or a fine still depends on an appeal that has not been heard.
