Everton and Burnley have been embroiled in a legal battle in a precedent-setting claim.

The Clarets are seeking compensation from the Blues after their breach of Profitability and Sustainability Rules (PSR), which contributed to the Turf Moor outfit’s relegation.

The trial is expected to start in the summer, with the Championship club seeking damages post their relegation.

Farhad Moshiri was the Everton majority shareholder when Burnley began legal action.

Mark Howard KC called on by Everton to defend them against Burnley

Everton need representation in the case against Burnley and they have turned to Brick Court’s Mark Howard KC, per The Lawyer.

Howard has been billed as one of the Bar’s most experienced counsel.

MORE TOFFEES STORIES

He will be the one defending the Blues in the precdent-setting claim which has been brought upon by the Clarets.

The claim could set a legal precedent for how financial fair play (FFP) or associated party transaction (APT) rules are interpreted and enforced in the Premier League.

These rules, as seen in the Manchester City case, regulate clubs’ financial dealings, especially with entities linked to their owners, to ensure fair competition.

Toffees fans can be optimistic given Mark Howard KC’s credentials

As per documents in the Brick Court Chambers, Howard has been hailed for his efforts.

He has been described as someone who “gives clever, shrewd and realistic advice and excels in cross-examination.”

He’s based in London and has been lauded for his work in high-profile cases, including those in commercial law, energy disputes and international jurisdictions.

Premier League table

The fact that the Toffees have turned to him suggests that they’re taking this seriously and aim to win it.

That said, it’s a positive for the club and the fans who can be optimistic of a win as he is one of the UK’s top legal minds.

It’s unclear when an outcome will be reached but it could take months or years, given the complexities of the process.

If Burnley are to succeed, this could see the Premier League and other governing bodies reshaping their rules to ensure nothing of this nature can happen again.
