The incident occurred in 2023, when Kemp allegedly fired shots at two individuals in the Tacoma Mall parking lot. Kemp claimed the people had broken into his vehicle and stolen several items, and told police he acted in self-defense.

Initially, Kemp was charged with first-degree assault with a firearm. Prosecutors later added a second count of first-degree assault, along with a charge of drive-by shooting.

Second-degree assault typically carries a standard sentencing range of three to nine months. However, the maximum penalty for the charge is up to 10 years in prison and a $20,000 fine. Kemp is scheduled to be sentenced on August 22.

During his NBA career, Kemp was regarded as one of the greatest dunkers of all time. He was a six-time All-Star and famously faced off against Michael Jordan and the 72–10 Chicago Bulls in the 1996 NBA Finals with the SuperSonics.
